How WARP Technology Co. collects, uses, shares, and safeguards information about you when you use our websites, mobile applications, SMS services, APIs, and dashboards.

WARP is based in the United States and processes information in the United States and other countries where our service providers operate. If you are located outside the United States, your information may be transferred to, stored, and processed in countries that have different data-protection laws than your country of residence. Where required by law (such as for EU/UK transfers), we rely on appropriate safeguards (such as the EU Standard Contractual Clauses).

9. How long we keep your information

We retain personal information only for as long as is necessary to fulfill the purposes described in this Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, regulatory, insurance, or legal requirements applicable to motor carrier and broker operations under the FMCSA and IRS).

When we no longer have a legitimate business need to process your personal information, we will either delete or anonymize it. If this is not possible (for example, because the information has been stored in backup archives), we will securely store the information and isolate it from any further processing until deletion is possible.

10. How we keep your information safe

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the confidentiality, integrity, and availability of your personal information. These measures include access controls, encryption in transit and at rest (where appropriate), network segmentation, audit logging, employee training, and vendor management.

However, no electronic transmission over the Internet or storage method can be guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk.

11. Children's privacy

The Services are not directed to children under 18 years of age. We do not knowingly solicit data from, or market to, children under 18. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to the minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"), provides you with additional rights regarding our use of your personal information.

In the preceding twelve (12) months, we have collected the categories of personal information described in Section 2 (Information we collect). We use this information for the purposes described in Section 3 (How we use information). We disclose information to the parties described in Section 5 (When and with whom we share your information). We do not sell personal information and have not sold personal information in the preceding twelve months. We do not knowingly sell or share the personal information of minors under 16.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the General Data Protection Regulation ("GDPR") and the UK GDPR apply to our processing of your personal information. We rely on the legal bases described in Section 4. You have the rights described in Section 12 above and the right to lodge a complaint with your local data protection supervisory authority. If you are located in Canada, we process your information consistently with the Personal Information Protection and Electronic Documents Act ("PIPEDA") and applicable provincial laws. We may process your information with your express or implied consent. You may withdraw your consent at any time by contacting us. In limited circumstances, we may process your information without your consent — for example, for investigations, fraud detection, business transactions, witness statements, identifying injured persons, financial-abuse investigations, journalistic purposes, or publicly available information specified by regulations.

17. Controls for Do-Not-Track features

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Notice.

18. Mobile information & SMS data

18.1 No sharing of mobile information with third parties

No mobile information collected as part of the WARP SMS program — including, without limitation, your mobile phone number, opt-in status, consent records, message content, message history, and message frequency preferences — is shared, sold, rented, leased, licensed, transferred, or otherwise disclosed to any third parties, affiliates, partners, marketing agencies, lead-generation services, or any other entity for any marketing, promotional, advertising, lead-generation, or affiliate-marketing purpose.

The only exception is sharing with subcontractors that strictly support our SMS messaging program (for example, our messaging platform provider Twilio), and only to the limited extent necessary to deliver, route, or troubleshoot the messages you have requested. These subcontractors are bound by written confidentiality and data-protection obligations and are prohibited from using your mobile information for their own marketing, advertising, or any secondary purpose.

WARP does not engage in affiliate marketing, lead generation, or the resale of mobile information collected through our SMS program. This restriction applies even if WARP is acquired, merged, or otherwise reorganized.

18.2 Opt-in workflow

SMS messaging from WARP is strictly opt-in. We obtain your express written consent through one of the following affirmative-consent workflows:

After you send the STOP message, we will send a one-time confirmation message and you will no longer receive SMS from that program. To opt back in, reply START or contact support@wearewarp.com. The WARP SMS program is purely operational and transactional. We send only the following categories of messages, all of which are directly related to the freight transportation Services you have requested:

If you would like to review or change the information in your account, or terminate your account, you can:

Upon a verified request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms, comply with applicable legal requirements, or fulfill records-retention obligations under the FMCSA, IRS, and similar bodies.

20. Updates to this notice

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Last updated" date, and the updated version will be effective as soon as it is accessible. If we make material changes, we may notify you either by prominently posting a notice of such changes on our Services, by directly sending you a notification, or by other reasonable means. We encourage you to review this Notice periodically to be informed of how we are protecting your information.
